February 7, 2013:
Effective February 1, 2013, a local HR representative of the Beijing sponsoring company will be required to be present at the Beijing Labor Bureau at the time of submission of an employment license application.
This representative is to be involved in the recruitment of the prospective foreign employee that is covered by the employment license. Several questions will be asked that involves:
- The reasons why the foreign applicant is assigned / hired to work in the company in Beijing.
- he number of foreign and local employees currently in the company.
- Company’s business background.
Proper identification of individual and respective position should be prepared prior to filing the application. This change has been made in an effort to better determine that the needs of an employer cannot be filled by a domestic employee.
It should be noted that this is the only change to be implemented in the work authorization in Beijing – all other stages remain unchanged. Also, only Beijing is implementing this change; no other city is enacting similar requirements.
